The objective of this task is to negotiate and agree on the employee rights of to-be-transferred staff.

In some countries local law might dictate how to deal with current employee rights. Where this is not the case agreement is needed with the current employer on how to deal with these rights. There can be many types of employees rights that need to be agreed upon and there might by many parties involved in the negotiations.

For example any pre-authorized leave or if there are employees that would receive a bonus for being 25 years in the company but would just miss that due to the transition there might be compensation agreed with the current employer.

The costs of the staff transfer is calculated per person taking all costs elements into account like:

  • Conversion of current terms and conditions into Capgemini terms and conditions
  • Special arrangements
  • Local law arrangements and requirements
  • Agreements with the current employer.

The agreement with the current employer and/or other parties to involve on how to deal with current employee rights is converted into costs. The artifact Staff Transfer Cost Calculation is updated to reflect the related costs, the artifact Staffing Gap Plan is updated with the new ideas about what staff will be taken over.
